GIFT CARDS TERMS OF SALES
The terms used in these general terms and conditions of sale and use have the following meanings:
General Terms and Conditions of Sale and Use or General Terms and Conditions:
These general terms and conditions of sale and use apply to each purchase or use of the Gift Card.
Gift Card or Card:
Physical or digital card, credited with a certain amount (minimum 30 euros) that can be used as a means of payment within the LUPICIA Paris store and on the website www.lupicia.fr.

Customer(s)
Natural person(s) who purchase(s) in Store or on the Website or use(s) the Gift Card within the LUPICIA Paris store.
Parties:
The Client and/or LUPICIA
Article 2 – Purpose
These General Terms and Conditions of Sale and Use of the LUPICIA Gift Card govern all relations between:
- On the one hand, LUPICIA FRANCE, SARL (Société à Responsabilité Limitée) with a share capital of 200,000 euros, registered with the Paris Trade and Companies Register under number 527 584 783, whose registered office is located at 40, rue Bonaparte, 75006 Paris.
- On the other hand, any individual who purchases or uses a LUPICIA Gift Card
The purpose of these General Terms and Conditions is to describe the terms and conditions of sale and use of Gift Cards between LUPICIA and their Customers.
Any purchase or use of the Gift Card implies full and unconditional acceptance of these General Terms and Conditions, which are provided to the Customer upon request. They express the entirety of the obligations and rights of the Parties.
LUPICIA reserves the right to modify its General Terms and Conditions at any time. The applicable General Terms and Conditions are those in effect on the date the Customer purchases the Card.
Article 3 – Gift Card
Thanks to the amount credited to the Gift Card, the Customer will be able to use this means of payment to pay for all goods in the LUPICIA Store and for an online purchase on the Website.
Article 4 – Gift Card Purchase Process
Gift cards are available for purchase in-store or online.
Gift cards cannot be purchased using gift vouchers.
4.1. In-Store Purchase
Gift Cards can be credited in a single transaction when purchased in-store for a minimum amount of 30 euros and a maximum amount of 150 euros.
4.2. Ordering on the Website
Gift cards can be credited in a single transaction when purchased on the website. The customer must choose from the following amounts: €30, €50, €80, €100, €120, €150.
After completing the online payment, the physical Gift Card can be collected by the Customer in-store or sent by mail to an address specified by the Customer, according to the terms and conditions indicated during the online purchase process. This Gift Card is delivered exclusively within France.
Article 5 – Gift Card Features
The Gift Card is not registered to a specific name.
The Gift Card can be used in one or more transactions until its balance is depleted, up to a limit of €150 (one hundred and fifty euros). No change will be given for purchases of goods less than the value of the Gift Card or the remaining balance on the Gift Card.
In the event that the Gift Card does not fully cover the amount of the purchases, it is possible to complete the payment with another payment method accepted in Store.
In the event of additional payment in cash for a tax resident in France, the total amount paid by the Client cannot exceed 1000 (one thousand) euros (including Gift Card credit).
In the event of additional payment in cash for a tax resident outside France, the total amount paid by the Client cannot exceed 10,000 (ten thousand) euros (including Gift Card credit).
The Gift Card is valid for 1 (one) year from the date of purchase.
Article 6 – Payment
6.1. Amounts billed
Gift cards are charged in euros.
The amount credited to the Gift Card must be paid in full at the time of purchase.
6.2. Accepted payment methods
Gift Cards are available for sale at all cash registers available in Store and on the Website.
The Gift Card can be paid for using the payment methods accepted in Store.
A Gift Card cannot be used to purchase other Gift Cards.
Article 7 – Checking your Gift Card balance
Your Gift Card balance and recent transactions can be checked free of charge with our in-store team upon presentation of the card or card number, or by contacting customer service at +33 1 84 17 66 83 or by email at kdo@lupicia.fr . The balance is not available online on the website.
Article 8 – Returns and refunds
8.1. Return
In the event of a return of the item(s) paid for using the Gift Card, the corresponding amount(s) will be refunded to a new Gift Card.
8.2. Refund
The Gift Card cannot be exchanged, resold, credited to a card or bank account, nor can it be exchanged for monetary compensation in any form whatsoever, in whole or in part.
In case of loss, theft or destruction, the remaining funds on the Gift Card cannot be refunded.
To replace a Gift Card in case of loss, theft, or destruction, the Customer must report it lost or stolen. This report can be made using the Card number by contacting LUPICIA customer service, which can be reached by phone from mainland France at 01 84 17 66 83, between 9:30 a.m. and 12:30 p.m. and between 1:30 p.m. and 4:30 p.m., Monday to Friday, or by email at kdo@lupicia.fr . Once the report is processed, the Gift Card will be replaced with a new Gift Card credited with the remaining balance.
Article 9 – Right of Withdrawal and Time Limits
In accordance with the provisions of Article L. 221-18 of the French Consumer Code, in the case of a distance sale of a Gift Card on the Website, the Customer has a period of 14 (fourteen) days from the day of receipt of the order to exercise their legal right of withdrawal without having to justify their decision. This right applies provided that the Gift Card has not been used in whole or in part before the expiry of this period. Indeed, in this case, no right of withdrawal or refund of any kind is provided.
Article 10 – Contact and Complaints
These General Terms and Conditions are subject to French law.
Transactions recorded by the Store's computer systems constitute proof of transactions actually carried out using the Card.
Step 1. In the event of a dispute regarding the balance of the Card following its use, any claims must be sent, within 3 (three) months from the disputed transaction, to the LUPICIA customer service department, attaching the receipts supporting the purchase, to the following email address, which will handle the processing and follow-up: kdo@lupicia.fr .
Step 2. The Customer may submit a written complaint to the FEVAD (French Federation of E-commerce and Distance Selling) E-commerce Mediator Service, whose contact details are as follows: 60 Rue La Boétie – 75008 Paris – //www.mediateurfevad.fr/. After consumers have first contacted LUPICIA in writing, the Mediator Service may be contacted for any consumer dispute that has not been resolved.
Article 11 – Personal Data
The personal data collected from our Customers in connection with the Sale and Use of the LUPICIA Gift Card is processed electronically for the purposes of managing operations related to said Gift Card. This data is intended for LUPICIA. It will be kept for a period not exceeding the time necessary for managing operations related to the Gift Card, after which it will be deleted.
If the Customer has provided their email address, they may receive electronic communications from LUPICIA regarding the management of the business relationship, for the purposes of fulfilling and managing this contract, and, where applicable, for after-sales service. They may also receive information about products or services similar to their purchase.
In addition, if the Customer has agreed to receive our information and commercial offers by email and on social networks, or by SMS, his personal data will be kept for a maximum period of three (3) years from its collection or the last contact from him.
In accordance with the French Data Protection Act of 6 January 1978, relating to information technology, files and freedoms, as amended, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the "GDPR"), the Client has the right to access, rectify, port, restrict, erase and object to the processing of personal data concerning him/her.
The Customer may object free of charge to the use of his contact details or exercise his rights by writing to LUPICIA Customer Service – 5bis, rue Georges Méliès 78390 Bois d'Arcy, or to kdo@lupicia.fr .
If, after contacting us, he believes that his data protection rights are not being respected or that the processing of his request does not comply with data protection rules, he can file a complaint online with the CNIL or by post.
