RULES "LUPICIA BIRTHDAY DRAW" GAME
WITH OBLIGATION TO PURCHASE OPEN FROM 09/13/23 TO 10/20/23

 

Article 1: object

The company LUPICIA (hereinafter the “Organizing Company” or “LUPICIA”), a simplified joint-stock company with capital of 200 000 euros, whose registered office is located at 40, rue Bonaparte 75006 Paris - registered in the trade and companies register under SIRET number 52758478300049, represented herein by Mr. Jean Playe, in his capacity as Managing Director, is organizing a draw (hereinafter the “Games”), from 09/13/2023 to 10/20/2023 11:59 p.m. via its website www.lupicia.fr and its shop located at 40, rue Bonaparte 75006 Paris.


Article 2 — Attendance

2.1 Access to games

These Games are open to any adult or minor natural person, residing in France, Switzerland and around the world, (hereinafter the "Participant"), with the exception of staff members of the organizing structures of the Game, and any person who participated directly or indirectly to its organization or its realization.

When designating the winners, the Organizing Company reserves the right to ask any Participant to justify these conditions. Any person who does not meet these conditions or refuses to justify them will be excluded from the Game and will not be able, in the event of a win, to benefit from the prize. Similarly, any false statement, indication of identity or address will result in the immediate elimination of the Participant.

Participation in the Game implies full acceptance of these rules.


2.2. Terms of participation

To participate in the draw, it is necessary to make a purchase, whatever the amount, on our online sales site www.lupicia.fr or in store at 40, rue Bonaparte 75006 Paris between 09/13/2023 to 20 /10/2023.

For in-store purchases, the participant must complete a participation form mentioning their last name, first name, telephone number and e-mail.

For a purchase on the site, participation is automatic from the moment the order is validated and paid. In the event of cancellation and refund of purchases or order, participation will be canceled.


Article 3 — Endowment

The winners undertake to accept the prize as offered, without the possibility of exchanging it for cash or other goods or services of any nature whatsoever. The Organizing Company reserves the right to replace any prize with another prize equivalent in terms of its value and characteristics, for any reason whatsoever without its liability being incurred in this regard.



Article 4 — Allocation of grants

The winners will be contacted within 15 days following the closing of the competition by email or telephone by the Organizing company.

Product prizes and purchase vouchers (in the form of a promotional code to be used on the Internet or communicated in store) will be sent within 15 days from the date of designation of the winners. If the winner does not appear within 7 days after the announcement of the results, the latter will be considered to have given up their prize and a new winner will be designated for this same prize.

The winner must comply with the rules. If it turns out that the winner does not meet the criteria of these regulations, his prize will not be awarded to him.

The prize cannot give rise to any dispute or claim of any kind. The winner undertakes not to seek liability from the Organizing company with regard to the prize.

The lot will be accepted as announced. No changes of any nature whatsoever may be requested by the winner, for any reason whatsoever. No consideration, compensation or financial equivalent of the prizes can then be requested, totally or partially.

It is specified that the organizing company will not provide any service or guarantee, the winnings consisting solely of the award of the prizes provided for above.

5.1 Within the framework of the Game, participants communicate to the Organizing Company, which will be the sole recipient, personal data concerning them.

Article 6 — Limitation of liability

Participation in the Game implies the unreserved acceptance of these rules in their entirety, the rules of ethics in force on the Internet, as well as the laws, regulations and other texts applicable in France.

Participation in the Game implies knowledge and acceptance of the characteristics and limits of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses circulating on the Internet network.

The Organizing Company shall not be liable in the event of a malfunction of the "Internet" network preventing access to the game or its smooth running. In particular, the Organizing Company cannot be held responsible for any external malicious acts.

Although the Organizing Company makes every effort to provide users with available and verified information and/or tools, it cannot however be held responsible for errors (in particular display on the game sites, erroneous emails), lack of availability of information and/or the presence of viruses on the site.

It is up to each participant to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any attack. The connection of any person to the site and participation in the game is under their sole responsibility.

In addition, the Organizing Company is not responsible in the event of:

• Telephone connection problems,
• Hardware or software problems,
• Destruction of information provided by participants for a reason not attributable to the Organizing Company,
• Human or electrical errors,
• Disruptions that could affect the smooth running of the game or malfunction of the automated draw process.

In all cases, if the proper administrative and/or technical progress of the game is disrupted by a cause beyond the control of the Organizing Company, the latter reserves the right to interrupt the game. Any fraud or non-compliance with the these rules may give rise to the exclusion of the game of its author, the Organizing Company reserving, if necessary, the right to take legal action against it.


Article 7 — Access and interpretation of the regulations, modifications

No oral request regarding the Game will be responded to. Any complaint must be sent in writing to the Organizing Company at the address mentioned above before 11/15/2023. After this period, no claim will be accepted.

7.2 Interpretation of the regulations

Any question of application or interpretation of the regulations, or any unforeseen question that may arise, will be decided sovereignly by the Organizing Company.

7.3 Changes

The Organizing Company reserves the right to extend, shorten, modify or cancel the Game at any time, and in particular in the event of force majeure, without the participants being able to claim any compensation.

Article 8 — Applicable law and jurisdiction

These regulations are subject to French law.

Any dispute relating to the application or interpretation of these regulations will, in the absence of an amicable settlement between the Parties, fall within the jurisdiction of the Paris High Court.
